Term and Conditions

Any and all bookings are made with SunBoar.com, acting as a representative agent on behalf of the owner/s, of the properties displayed or shown in the company website or elsewhere. With the payment of any deposit, for the rental rate as displayed, it shall be taken as confirmation of acceptance of the terms and conditions that are:

 

1.  Our Booking Process

 

Provisional Confirmation of Availability and Rates

Once a receipt of a request confirmation of availability has been logged, the relevant and applicable Villa/ property rates as well as the correct deposit required will be advised. All bookings work on a “'first-come, first-served” basis and are for a minimum of three (3) nights, unless otherwise specified in the confirmation of availability. This may change during certain periods of the calendar year. SVPS reserves the right to decline a booking without giving any reason.

 

Additional Charges and Exclusions

All rates shown do not include any collections or return of or baggage handling, gratuities, telephone or fax charges, vehicle rentals, food and beverage, personal items and expenses due to any other third parties, and any recovery, repair of or excessive cleaning required upon departure (such as upholstery or rug shampooing, etc) or replacement of cutlery or crockery breakages, while fair wear and tear is accepted.

 

Initial Deposit

A booking will deemed to be confirmed upon receipt of the specified initial deposit of three (3) nights, unless otherwise specified regarding the confirmation of availability.

 

During specific seasons, i.e. the Christmas and New Year period and Easter, fifty percent (50%) of the villa rental will be required to confirm a booking.

 

No valid contract will exist with SunBoar.com until receipt of funds Prior to any booking is confirmed and a contract comes into existence, SunBoar.com reserves the right to increase or decrease the agreed prices.

 

In the event that the agreed funds are not received within a reasonable time period, i.e. 5 banking days, the reservation shall be cancelled and SunBoar.com reserves the right to allocate the Villa or property to another client.

 

In the event of a booking been cancelled, cancellation charges will be payable in accordance with paragraph 3 below.

 

Balance of Payment

Following the receipt of the initial deposit to confirm the booking, the outstanding balance has to be paid a minimum of 30 days prior to the day of arrival, unless otherwise specified in the confirmation of availability.

 

In the event that the booking is made within 30 days of the arrival date, then the full payment is due upon confirmation and prior to arrival.

 

2.  Payment

 

All major payment options are supported and may differ by villa or property.

 

In the event that SunBoar.com does not receive the balance of payment by the due date, SunBoar.com reserves the right to cancel the booking and apply cancellation charges.

 

Should the booking be made within 30days of the arrival date, then the full payment is due upon confirmation and prior to arrival. This is applies to all seasons.

 

3.  Cancellations and/or Amendments to Reservations

 

We understand that there may be occasions where it becomes necessary or unavoidable to cancel all or any part of a booking. Should this unfortunate situation occur, then SunBoar.com has to be notified in writing (an e-mail is acceptable). The cancellation will only become effective from the day that the written confirmation is received.

 

Cancellation charges will be applied depending on when the notification of the cancellation is received in writing as well as the period of stay in the villa:

 

Standard and Peak Seasons: - 30 days or more before arrival date:

 

All payments received are forfeited; however, the value of the payments received up to the cancellation date, will be credited for a maximum period of nine (9) months from the date of the cancellation confirmation by SunBoar.com. This credit value may be used by the client or anyone on their behalf, for any reservation, during any period upon availability and, exclusively for the same villa reserved initially.

 

30 days or less prior to arrival date:

 

All rental payments are forfeited. Any refund (full or partial) is only applicable should SunBoar.com secure another reservation that covers the initial cancelled reservation.

 

Festive Season (Christmas and New Year period):

 

All rental payments received are forfeited. Any refund (full or partial) is only applicable should SunBoar.com secure another reservation that covers the initial cancelled reservation.

 

The above stated cancellation charges will also apply if SunBoar.com is forced to cancel the booking due to non-payment of the balance. If the dates of the booking require changing or amending, this may be treated as a cancellation of the original booking and cancellation charges may apply. Any change to the original reservation is subject to an evaluation and approval by SunBoar.com.

 

Any penalty charge for early departure will be subject to negotiation with SunBoar.com.

 

Should it happen that SunBoar.com has to cancel or change a confirmed reservation, even though highly unlikely and only as a result of totally unforeseen circumstances, we will advise you at the earliest possible date, through any means possible.

 

For example, should it happen that the villa or property is damaged or rendered unusable, the SunBoar.com will endeavor to accommodate the client Guests to at an alternative villa or property for the period required. However, there is no absolute guarantee that this can be done. In the event that this is not possible, or the client elect not to be elsewhere accommodate, SunBoar.com will cancel the reservation and refund monies paid in full for the villa or property, less any bank transfer charges. SunBoar.com shall not be liable for any further obligations or claims by the client.

 

4.  Arrival and Departure

 

The standard Check In time is 3:00pm (15h00) and Check Out time is 10.30 am (10h30). Any request for an early arrival or late departure will depend solely upon availability of the villas at the time of arrival or departure.

 

The responsibility for providing the correct arrival details (i.e. flight number and carrier) lies with the client. This applies specifically is an airport transfer is part of the SunBoar.com service.

 

5.  Registered Guests

 

The only persons allowed residing at the villa or property is those stipulated on the booking form as guests. Should there be any changes to these names, the onus lies with the client to notify us as soon as possible. The total number of people staying at the property, including children, may not exceed the maximum capacity indicated in the property description or elsewhere. The only exceptions are infants (less than two years old), or unless specifically authorized prior to arrival.

 

In the event that the villa or property owner or the local representative from SunBoar.com finds that the number of people staying at the property exceeds that on the booking form or the maximum capacity of the villa, they may, at the absolute discretion of SunBoar.com, request the extra person or persons to either pay the applicable additional charge as per the published rate or to vacate the property with immediate effect.

 

SunBoar.com regrets to inform that no camping is permitted on the property grounds, nor are any pets allowed on the entire property.

 

Of course it is fine for a party to be organized within the property but this needs to be done within reason. In the event that a party or function is held for a number of guests in excess of one and a half times the maximum occupancy capacity of the villa or property, then a surcharge is applicable and will be collected on site. In addition a guarantee deposit will be collected on site and from which a cleaning surcharge may be deducted before refund to the guests.

 

6.  Security Deposit

 

Since there is always the risk of damage or breakages during a client’s stay, it may be required to pay a security deposit to SunBoar.com with the payment of the balance. This would be allocated to cover the cost of repair or replacement of any items or fixtures that may have incurred damage or breakage during the rental period of the villa or property or its contents. It may also be used to cover the cost of the use of telephones and other services.

 

Upon the departure of the client, this amount will be returned, less any such costs.

 

7.  Insurance

 

It is not only sensible and good practice but also a minimum requirement of the reservation that the entire party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).

 

Both SunBoar.com and the owners of the rented properties are held harmless by the client and their party against any and all claims including any accidents related to the use of the villa or property facilities or locally procured third party services such as, but not limited to, watercraft, water sports, motor vehicle or motorbike rental.

 

SunBoar.com shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside of the control of SunBoar.com control such as civil disturbances, fires, floods, severe weather, Acts of God, acts of Government etc.

 

By accepting this contract it is assumed by SunBoar.com that this requirement has been complied with in full.

 

8.  Grievances or Complaints

 

All property descriptions, as provided by SunBoar.com, on the website and elsewhere, are made in good faith. Logic dictates that each villa and property varies in standard, quality and finish and there are obvious differences in style and decor.

 

Since SunBoar.com acts as a representing agent for the villa or property owner, we do not accept responsibility for any modifications made which are not mentioned on the website or anywhere else. It is important to note that neither SunBoar.com nor the villa or property owner can be held liable for the breakdown of the supply of government water or electricity, nor internet connections, mechanical or hydraulic systems such as household water supply or swimming pool filtration systems, though we will do our utmost to arrange for any such problems to be solved quickly, should any of these occur.

 

Should any problems occur during the rental period, and this cannot be resolved directly by the local villa staff, SunBoar.com will use its best endeavours to correct the situation to client’s satisfaction in the shortest possible time frame. Even though it is generally understood and accepted that local infrastructure, standards and conditions are often of a less developed nature than what clients may be conditioned to.SunBoar.com will do as much as can be reasonably expected to avoid and rectify any problems that may occur, but cannot be held responsible for any problems beyond its control.

 

In the event of any complaints or grievances, SunBoar.com must be notified within 24 hours of the occurrence giving rise to the complaint or grievance, and must then be followed up in writing before departure. In the unlikely event that a problem, that has been noted, remains unresolved, it would be appreciated if a formal written complaint can be submitted within 14 days of the completion of the rental period. If the Villa is vacated before the end of the rental period without mutual agreement this may result in the loss of all rights to compensation.

 

No complaint will be considered if this is made after the departure date or if not received and acknowledged by SunBoar.com or the villa owner.

 

9.  General conduct

 

The client (i.e. the person paying the deposit for the villa rental) accepts the responsibility for the correct and appropriate behaviour of all the guests staying at the villa or property. In the event that any member of the party behaves in an inappropriate manner that may be considered generally unacceptable, then either SunBoar.com or  the villa owner may, at their absolute discretion, ask the offending person/s to vacate the premises  forthwith.

 

Should this type of action be required, then it will be treated as a cancellation of the original booking and hence no refund can be claimed from either SunBoar.com or the villa owner.

 

10.  Villa staff

 

Some of the villas or properties have core staff present on-site (i.e. villa manager, cleaning staff, maintenance personnel etc). Additional services are on offer and may be sourced upon request – examples of these are child minders, private chef, driver – due to availability, such services cannot necessarily be guaranteed.

 

Depending on the season of the year, the availability of additional staff may be limited and hence we recommend that the client indicate their preferences well in advance. SunBoar.com will assist as far as possible in securing the services of requested staff, but we cannot assume any liability for such sub-contracted staff.

 

11.  Linen and towels

 

Linen and towels are provided at the villa or property, unless specifically indicated to the contrary. These are normally changed every three (3) days. Should more frequent changes be requested this may incur extra charges. Laundry options may be available and can be arranged for a small service charge. Laundry costs incurred must be paid at the time incurred or latest at the time of departure.

 

12.  Valuable items

 

A personal safe is provided in the villa. It is strongly recommended that any valuable items such as passports, laptop computers, cash, traveler’s cheques, mobile phones, cameras etc. are stored here for safe-keeping.

 

Any valuables left at the property are the guest's sole responsibility and neither SunBoar.com nor the owner nor the staff can be hold responsible for any loss or damage of personal property.

 

It is advised that all doors and windows remain locked at night to avoid any temptation.

 

13.  Awareness and care

 

The responsibility of taking due care while residing in the villa, lies with the client. This refers more specifically to children and the awareness of children playing in the garden, close to the road; near or in the pool or jacuzzi, on the beach, or in the sea. Guests are not permitted to enter the villa when wet from swimming as the floors can be slippery. Any damage or injury resulting shall not be the responsibility of SunBoar.com or the villa owner.


14.  Applicable law

 

These conditions and any contract to which they apply, are governed in all respects by Thailand  law and the Thailand courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.

 

15.  Agreement

 

I/We agree to the above conditions and do hereby agree to the application of the above Terms and Conditions to our reservation.
